1. Who is responsible
The controller responsible for data processing under the EU General Data Protection Regulation (GDPR) for the XELUNE apps for macOS, iPadOS and iOS and for the website xelune.app is:
Aiaggregate
Udo Popp, sole proprietor
Haniklstr. 13
81829 München
Germany
Phone: +49 89 58808388
Email: support@xelune.app
Please use this address for any question about your data or to exercise the rights described below.
2. Data that stays on your device
To work, XELUNE stores the following locally on your Mac, iPad or iPhone:
- mixer state: levels, armed tracks, noise colour, beat frequency, mode, carrier tone and filter settings;
- your saved scenes and their names;
- sleep timer preferences;
- a reference to the soundfile folder you chose, and soundscapes you have downloaded.
XELUNE reads the audio files in the folder you select only to play them. They are never uploaded to us or anyone else. None of this data is transmitted to us. It is removed when you delete the app.
3. iCloud sync
If you turn on Sync Settings via iCloud, the settings and scenes listed above are stored in your personal iCloud account so your devices can share them. Files you place in iCloud Drive › XELUNE › Sounds are synced by iCloud Drive.
This storage belongs to your Apple Account and is operated by Apple. We have no access to it and cannot read, copy or delete its contents. Apple's handling of this data is governed by the Apple Privacy Policy. You can switch sync off at any time in XELUNE's settings and manage stored data in your device's iCloud settings.
4. Purchases
XELUNE Pro is sold through the App Store. Apple processes the payment, your billing details and your purchase history. We only receive anonymous, aggregated sales reports from Apple that do not identify you. On your device, the app asks Apple's StoreKit service whether Pro has been purchased so it can unlock the features; this check happens between your device and Apple.
5. Downloading soundscapes
When you browse or download soundscapes, XELUNE requests a catalogue and the corresponding audio and artwork files from our server at xelune.app. Like any web server, it automatically processes the technical data needed to deliver those files:
- your device's IP address;
- date and time of the request;
- the file requested and the amount of data transferred;
- technical information sent with the request, such as the app and system version.
The request contains no account, no advertising identifier and no device identifier. We do not combine this data with other sources or use it to build a profile. It is kept in the hosting provider's server logs only for operating and securing the server, and is deleted automatically when those logs are rotated.
Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest is delivering the content you asked for and keeping the server secure.
6. This website
xelune.app does not use cookies, analytics, tracking pixels, social media plug-ins or embedded third-party content. Fonts are served from our own server, so visiting the site causes no requests to Google or any other third party.
When you open the site, the server logs the same technical data described in section 5, for the same purpose and on the same legal basis.
7. Contacting support
If you write to us, we use your email address and whatever you include in your message, such as device details or screenshots, only to answer you. Legal basis: Art. 6(1)(b) GDPR where your request concerns your purchase or use of the app, otherwise Art. 6(1)(f) GDPR. We delete the correspondence once your request is resolved, unless we are legally required to keep it longer.
8. Service providers and transfers
The website and the soundscape files are hosted by Namecheap, Inc., USA, which processes the server data described above on our behalf. Because the provider is based outside the European Union, data may be transferred to the United States. Such transfers rely on the safeguards the provider offers under Art. 46 GDPR, in particular the EU Standard Contractual Clauses.
Apple acts independently for iCloud, the App Store and diagnostics under its own privacy policy.
We do not sell, rent or share your personal data with anyone else.
9. Crash reports from Apple
If you have chosen in your device settings to share analytics with app developers, Apple may provide us with crash reports and aggregated usage statistics. These do not identify you. You can change this setting at any time under Settings › Privacy & Security › Analytics & Improvements on iPhone and iPad, or the equivalent section in System Settings on the Mac.
10. Children
XELUNE does not collect personal data from anyone, including children. The app contains no account, chat, advertising or social features.
11. Your rights
Under the GDPR you have the right to access the personal data we hold about you, and to rectification, erasure, restriction of processing and data portability. Where we rely on legitimate interests, you have the right to object to the processing. In practice we hold almost nothing that could identify you, but we will answer every request.
Write to support@xelune.app. You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU member state where you live.
12. Changes to this policy
If XELUNE gains features that change how data is handled, we will update this page before those features ship and change the date at the top. The current version is always available at xelune.app/privacy.
